Fyndiq’s Privacy Policy

Fyndiq protects your privacy and always strive for a high level of data protection. This privacy policy explains how we collect and use your personal data on the Fyndiq marketplace. The privacy policy also informs you about your rights and how you can use them.

We want you to feel comfortable with how we process your personal data and therefore it is important that you read and understand our privacy policy before using our services. You can always contact us at privacy@fyndiq.com if you have any questions.

Which information do we collect about you?

We collect the personal data that you provide to us, for example in connection with a purchase or when contacting us. Below you will find further information about what information we collect and why. In addition, personal data may be collected from other sources, e.g. from Svea, public authorities or from publicly available registers.

Why do we need your personal data?

For you to make purchases on Fyndiq

We need information about you in order for you to make a purchase on Fyndiq. The personal data we need is:

  • Contact information (e.g. name, e-mail, address and telephone number)

  • Information about your purchase (e.g. product information and payment information)

  • The information is needed to fulfil the purchase agreement with you.

The personal data will be stored for this purpose for three years from your last purchase.

To handle your customer service matters

We need your personal data to help you when you contact our customer service. The personal data that may be processed for our customer service are:

  • Contact information (e.g. name, e-mail, address and telephone number)

  • Purchase history

  • Customer service history

  • Other information that may be documented in connection with you contacting customer service

The information is needed to satisfy your and Fyndiq's legitimate interest to handle your questions and/or any complaints about the products you have purchased on our marketplace.

The personal data will be stored for this purpose for three years from your customer service case has been closed.

To send newsletters and offers

We need your personal data to be able to send you newsletters, offers, product samples and similar via email, mail and in our app. The personal data processed for this is:

  • Contact information (e.g. name, e-mail, address and telephone number)

  • Purchase history

  • User behaviour (e.g. clicks and visit history)

The information is needed to satisfy your and Fyndiq's legitimate interest to contact you and market our services and news, as well as provide you with offers, product samples and similar from our marketplace.

The personal data will be stored for this purpose for one year from your last purchase or your most recent interaction with Fyndiq (e.g. by opening our emails or otherwise showing an interest in Fyndiq's services). You can always choose to end our mailings earlier by following the instructions in the mail or contacting our customer service.

To be able to handle your participation in competitions and events

We need your personal data to be able to communicate with you, nominate winners and provide any prize if you participate in our competitions and/or events. The personal data we need is:

  • Contact information (e.g. name, e-mail, address and telephone number)

  • Information provided in competition entries or events

  • The information is needed to satisfy your and Fyndiq's legitimate interest in managing your participation in competitions and/or events.

The personal data will be stored for this purpose during the competition/event (including any evaluation).

To be able to evaluate, develop and improve our services

We need your personal data to be able to make our services more user-friendly, develop and improve our assortment, improve our IT systems and in other ways evaluate, develop and improve our services. The personal data we need is:

  • User behaviour (e.g. clicks and visit history)

  • Feedback (e.g. opinions or reviews)

  • Purchase history

  • Location data

Technical data about the devices used and their settings (e.g. language setting, IP address, browser settings, time zone, operating system, screen resolution, platform and version of the app)

  • Customer service history

  • Consumer ID (a unique code created for each consumer)

  • Results from customer satisfaction research or market surveys

The information is needed to satisfy Fyndiq's and our customers' legitimate interest in evaluating, developing and improving our services.

The processing is to the most part on an aggregated level by using deidentified or pseudonymised information, without any connection to you as an individual. To the extent that we process personal data for this purpose, the data will be stored for three years from your last purchase or last visit on the website.

To fulfill Fyndiq's legal obligations

We need your personal data to fulfil our legal obligations under law, judgments or government decisions (e.g. accounting acts, money laundering acts or rules on product liability and product safety). The personal data we need is:

  • Contact information (e.g. name, e-mail, address and telephone number)

  • Purchase history

  • Customer service history

  • The personal data is processed to fulfil Fyndiq’s legal obligations under law.

The personal data will be stored in accordance with any storage requirements in relevant laws, if such laws does not specify storage requirements, the personal data will be stored for this purpose for three years from your last purchase.

To prevent misuse of our services or to obstruct, prevent and investigate crimes against Fyndiq

We need your personal data to prevent and investigate any fraud, harassment or other actions that are prohibited by law or in accordance with Fyndiq's General Terms and Conditions. The personal data we need is:

  • Contact information (e.g. name, e-mail, address and telephone number)

  • Purchase history

  • Customer service history

  • User behavior (e.g. clicks and visit history)

The personal data is needed to fulfil a legal obligation (if any) or to satisfy Fyndiq's legitimate interest in being able to prevent misuse of our services or to obstruct, prevent and investigate crimes against the company.

The personal data will be stored for this purpose for three years from the suspicion of misuse or crime.

To handle reports of infringement of intellectual property rights

If you report to us that you suspect someone is infringing your intellectual property rights, your personal data will be needed to investigate the matter. The personal data that can be processed within the framework handling such a case are:

  • Contact information (e.g. name, e-mail, address and telephone number)

  • Personal identity number (if you have a sole proprietorship)

  • Any other personal data provided through your report

The personal data is needed to satisfy your and Fyndiq's legitimate interest in handling reports regarding infringement of intellectual property rights.

The personal data will be stored for this purpose for three years from the time your case is closed.

With whom do we share your personal data?

Stores on Fyndiq

  • For you to complete your purchase on Fyndiq, we must share information about you with the store that will deliver the goods. The personal data transferred to the stores are:

  • Contact information (e.g. name, delivery address)

  • Information about your purchase (e.g. product information)

The stores are personal data processors regarding the received data and they process the personal data on behalf of Fyndiq.

Other personal data processors

For us to offer our services, we share your personal data with entities that are so-called personal data processors to us. A personal data processor is an entity that processes the personal data on our behalf and according to our instructions. We have personal data processors to assist us with e.g. customer service, payment solutions, marketing and IT services.

When your personal data is shared with personal data processors, it is only for purposes that are compatible with the purposes for which we have collected the data. We have agreements with all personal data processors and they guarantee the security of the personal data processed and undertake to comply with our security requirements as well as restrictions and requirements regarding international transfer of personal data.

Other personal data controllers

We also share your personal data with other entities who are independently responsible for the personal data, e.g. government agencies if we are required to do so by law or on suspicion of crime. When your personal data is shared with such entities who are independently responsible for your personal data, their privacy policy and processing of personal data apply.

How long do we store your data?

We never store your personal data for longer than is necessary for each purpose. For further information about the specific storage periods, please see each purpose above.

Where do we process your personal data?

Our personal data processors and stores are located in different parts of the world. Therefore, your personal data may be processed both within and outside the EU/EEA. Regardless of where your data is processed, we ensure to protect your personal data with all reasonable legal, technical and organizational measures at the same level as the protection offered within the EU/EEA.

How do we protect your personal data?

We use IT systems to protect the confidentiality, integrity and access to personal data. We have taken special security measures to protect your personal data against illegal or unauthorized processing (such as illegal access, loss, destruction or damage). Only those who need to process your personal data for us to fulfil our stated purposes have access to the data.

What are cookies and how do we use them?

Fyndiq uses cookies which are short text files sent from our web server and which are saved by your browser when you visit Fyndiq.

What are your rights?

Right to rectification and extract from the register

Fyndiq will do what is required by law to keep your personal data accurate, complete and up to date. You have the right to rectification of incomplete or incorrect personal data. You also have the right to request an extract from the register regarding the personal data that we process of you.

The right to object

If the processing of your personal data takes place on the basis of a balance of interests and you consider that your interest of privacy override Fyndiq's interest of processing your personal data, you have the right, with reference to your particular situation, to oppose the processing by contacting Fyndiq. If you oppose the processing, Fyndiq must show compelling reasonable grounds to continue process the personal data.

Right to erasure

Under certain conditions, e.g. when you have revoked a previously given consent and there is no other legal basis for further processing of your personal data, you have the right to request erasure of your personal data.

Right to restriction of processing

Under certain conditions, you have the right to restrict the processing of your personal data to only the storage of personal data, e.g. meanwhile Fyndiq is investigating whether you are entitled to deletion.

Right of access

You have the right to receive a confirmation from Fyndiq that your personal data is processed by the company and in that case get access to the personal data and the following information:

  • the purpose of the processing,

  • the categories of personal data concerned,

  • recipients of personal data (especially if they are located outside the EU/EEA),

  • the period the personal data is processed,

  • information about the rights set out in this privacy policy,

  • information about the source from which the personal data been provided, and

  • if there is automated decision-making, including profiling.

If you make the request electronically, you also have the right to receive a copy of your personal data in electronic format. Fyndiq has the right to charge a fee if you request more than one (1) copy of your personal data per year.

Right to data portability

When the processing of your personal data takes place automatically and is based on your consent or to fulfil or enter into an agreement with you, and provided that the personal data has been collected directly from you, you have the right to receive a copy of your personal data in a structured and commonly used machine-readable format.

Rights in relation to automated decision-making, including profiling

You have the right not to be subject to solely automated decision-making, including profiling, if such decision-making has legal effects or similarly significantly affects you. However, this right does not apply if the automated decision-making is necessary to fulfil an agreement with you, if the decision-making is expressly permitted by law or if you have given your explicit consent.

Complaints to the supervisory authority

You are welcome to contact Fyndiq with questions or complaints concerning the processing of your personal data. You also have the right to file a complaint about the processing of your personal data to the Finnish Data Protection Ombudsman, www.tietosuoja.fi, or another data protection authority in the country where you are located.

Who is responsible for the personal data we collect?

Fyndiq AB, reg. no. 556792-1712, Ynglingagatan 16, SE-113 47 Stockholm is the personal data controller of the company's processing of personal data.
